Clear Terms for a Transparent Solar Journey
These Terms explain the rules for using the Akash Solar Power website and the general conditions applying to solar enquiries, site surveys, quotations, installation, payments, approvals, warranties and after-sales support.
An enquiry is not a confirmed order
A project becomes binding only after the applicable written quotation, work order or agreement is accepted.
Final scope controls the project
Equipment, price, timeline, payment stages, warranty and exclusions are governed by the accepted project document.
Subsidy and savings are conditional
Government approval, DISCOM procedures, site conditions, weather, tariffs and consumption affect the final outcome.
Terms and Conditions of Akash Solar Power
These Terms and Conditions (“Terms”) govern access to and use of akashsolarpower.in and general dealings with Akash Solar Power (“Akash Solar Power”, “we”, “us” or “our”). By using the website, submitting an enquiry or requesting a service, you agree to these Terms to the extent applicable to that activity.
For a specific solar project, the accepted quotation, work order, invoice, technical proposal, warranty document and any signed agreement take priority over these general website Terms if there is a direct conflict.
Acceptance and Scope
These Terms apply to website visitors, prospective customers, customers and persons communicating with us regarding residential, commercial or industrial solar systems, including on-grid, off-grid and hybrid installations.
If you do not agree with these Terms, do not use the website or submit information through its forms. Continued use after an update means you accept the revised Terms for future website use and enquiries.
Website Use and Information
Website content is provided for general information about solar products, installation, subsidy guidance, net-metering support and related services. It is not a final technical, structural, electrical, financial or legal recommendation for a specific property.
We make reasonable efforts to keep information accurate, but product availability, prices, government schemes, DISCOM requirements, taxes, interest rates, warranty terms and technical standards may change.
References to potential bill savings, subsidy, installation duration, warranty, performance or return on investment are indicative unless expressly confirmed in the accepted written project documents.
Eligibility and Authority
You must be legally competent to enter into a contract and authorised to act for the property, electricity connection, household, company, institution or other entity for which the enquiry is submitted.
A tenant, employee, consultant, family member or representative must obtain all necessary owner, occupier, board, society, landlord or organisational permissions before approving a survey, installation or application.
Enquiries and Site Surveys
Submitting a website form, sending a WhatsApp message, calling us or requesting a free consultation does not create an obligation for either party to proceed with a project.
- You must provide accurate contact, electricity-bill, property and project information.
- A preliminary recommendation may change after physical inspection, load analysis or document review.
- A site survey may assess roof area, shading, access, electrical systems and installation feasibility.
- Specialised structural testing, civil design, soil testing or statutory certification is included only if expressly stated in writing.
- We may decline a project that appears unsafe, technically unsuitable, legally restricted or commercially unviable.
Quotations and Contract Formation
A quotation is valid only for the validity period stated in it and is subject to stock, site conditions, applicable taxes, regulatory requirements and technical feasibility.
A binding project contract is formed only when the customer accepts the quotation, work order or agreement in the required manner and pays the stated booking amount or advance, if applicable.
Verbal discussions, website messages or informal estimates do not modify the accepted scope. Any change in capacity, component, structure, civil work, wiring route, backup requirement or service must be recorded and accepted in writing.
Pricing, Taxes and Payments
- Project price, taxes, payment stages and payment method will be stated in the applicable quotation or invoice.
- Prices may change before acceptance because of component costs, taxes, freight, government rules, exchange rates or site requirements.
- Work may be scheduled, paused or withheld when an agreed payment is overdue.
- Payments should be made only to the account, payment link or authorised representative officially communicated by Akash Solar Power.
- The customer should retain receipts, invoices and transaction records.
Unless expressly included, charges for government fees, DISCOM fees, enhanced-load applications, meter replacement, structural certification, major civil work, roof repair, trenching, internet connectivity, crane access or additional cable length may be charged separately.
Customer Responsibilities
The customer is responsible for:
- Providing lawful access to the site during agreed working hours.
- Disclosing roof damage, leakage, weak structures, concealed wiring, asbestos, hazardous material or other known risks.
- Ensuring ownership, electricity-connection and identity documents are accurate and lawfully shared.
- Obtaining permissions from owners, housing societies, landlords, local bodies or other authorities unless included in our written scope.
- Keeping children, pets and unauthorised persons away from the work area.
- Providing suitable storage, access, water, power or internet connectivity when the accepted scope requires it.
- Not interfering with installation work or modifying the system without authorised technical approval.
System Design and Performance Estimates
Capacity, expected generation, savings and payback estimates are based on the information available at the time, including electricity bills, roof orientation, shading, weather data, tariff and expected consumption.
Actual results may differ because of:
- Weather, temperature, cloud cover, seasonal sunlight and natural module degradation.
- Dust, bird droppings, shading, nearby construction or failure to clean and maintain the system.
- Changes in electricity usage, tariffs, fixed charges, net-metering rules or export-credit calculations.
- Grid outages, voltage fluctuations, inverter shutdowns, equipment faults or delayed repairs.
- Roof changes, unauthorised modifications, internet disconnection or monitoring errors.
A standard grid-connected solar system normally shuts down during a grid outage for safety and does not provide backup unless suitable battery or backup equipment is expressly included in the system design.
Subsidy, Net Metering and Government Approvals
We may assist or guide customers with documentation, portal submissions, vendor coordination, inspection and net-metering steps where included in the accepted scope.
Subsidy, net-meter approval, sanctioned-load approval, meter installation and commissioning are controlled by government authorities, scheme administrators, DISCOMs and other third parties. Akash Solar Power cannot guarantee:
- Eligibility for any central or state subsidy.
- The amount or timing of subsidy disbursement.
- Approval of a portal application or technical feasibility request.
- The time required for inspection, meter installation or grid synchronisation.
- Continuation of a scheme, tariff, benefit or regulatory rule.
The customer must provide correct documents, maintain an eligible electricity connection and comply with scheme conditions. A rejection or delay caused by incorrect documents, customer ineligibility or government processing does not by itself make us liable for the subsidy amount.
Installation and Project Timelines
Installation dates are estimates unless a specific date is expressly guaranteed in the accepted project agreement. Work may depend on payment, material availability, safe access, weather, civil readiness, approvals and customer cooperation.
We will take reasonable care during installation. Pre-existing leakage, structural weakness, concealed services or property defects remain the customer’s responsibility unless the accepted scope specifically includes their repair.
Any direct physical damage caused by our proven negligence will be addressed in accordance with the accepted contract and applicable law. The customer must notify us promptly and allow a reasonable opportunity to inspect and rectify the issue.
Equipment, Product Changes and Ownership
The accepted quotation should identify the main system capacity, module, inverter, battery, structure and other material specifications. Minor accessories may vary according to technical suitability and availability without reducing the agreed functional standard.
If an identified product becomes unavailable, we will seek customer approval before using a materially different model or brand. Any price or warranty impact should be confirmed in writing.
Ownership of supplied equipment may remain with Akash Solar Power until the applicable project payments are received in full, to the extent permitted by law and the project agreement. The customer must not sell, remove or create third-party rights over unpaid equipment.
Warranties and After-Sales Support
Solar modules, inverters, batteries and other branded products are covered by the applicable manufacturer’s written warranty, not by a blanket website promise. Performance warranty, product warranty and workmanship support are separate and may have different periods and conditions.
Warranty documents, serial numbers, invoices and commissioning records should be preserved. Manufacturer warranty claims may require inspection, photographs, logs, testing, product removal or transport and remain subject to the manufacturer’s decision.
Warranty or free support may not cover:
- Misuse, accidental damage, theft, fire, flooding, lightning or other external events.
- Grid surges, abnormal voltage, unauthorised repair, relocation or system modification.
- Pest damage, corrosion from unusual site conditions or failure to follow maintenance instructions.
- Consumables, routine cleaning or items excluded in the written warranty.
- Internet, app, telecom or third-party monitoring-platform failures.
Maintenance and Safe Operation
The customer must operate and maintain the solar system according to product manuals, safety instructions and written recommendations. Panels should be kept reasonably clean and free from new shade or obstruction.
Only qualified persons should open electrical enclosures, handle DC connections, alter earthing, relocate equipment or work at height. Damage arising from unauthorised intervention may affect warranty and safety.
Maintenance visits, cleaning, replacement parts and annual maintenance contracts are chargeable unless specifically included in the accepted project scope or warranty.
Cancellation and Refunds
A customer requesting cancellation must communicate it in writing. The financial treatment will depend on the accepted quotation, project stage and costs already incurred.
- Before procurement or project work begins, eligible amounts may be refundable after deducting documented administrative or survey charges, if applicable.
- After customised design, portal work, procurement, fabrication, dispatch or installation begins, actual costs and non-cancellable supplier charges may be deducted.
- Custom-made structures, opened products, registered warranties and installed equipment may not be returnable unless defective or otherwise required by law.
- Any approved balance refund will be processed after reconciliation through the original payment method or verified bank details.
We may cancel or suspend a project for payment default, unsafe conditions, inaccurate documents, denied access, technical infeasibility or legal restrictions. Any unutilised amount will be reconciled after deducting lawful and documented costs.
Finance, EMI and Insurance
Any loan, EMI, credit facility or insurance is subject to the independent terms, eligibility checks, interest rates, charges, approval and documentation of the relevant bank, NBFC, insurer or service provider.
Akash Solar Power does not guarantee finance or insurance approval unless we are the identified contracting provider of that service. The customer should read all third-party terms before accepting a financial product.
Intellectual Property and Prohibited Use
Website text, layout, graphics, logos, photographs, technical content and other material owned by or licensed to Akash Solar Power may not be copied, republished, sold or used commercially without written permission.
You must not:
- Submit false, fraudulent, defamatory, unlawful or misleading information.
- Attempt to disrupt the website, bypass security or introduce malicious code.
- Scrape or reproduce substantial website content for competing commercial use.
- Impersonate another person or falsely claim authority over a property or electricity connection.
- Use our name, logo, quotation or project photographs in a misleading manner.
Third-Party Services and Links
The website may connect to WhatsApp, maps, social-media platforms, government portals, DISCOM websites, payment services, lenders, insurers, manufacturers or other external services.
Those services are controlled by independent providers and their terms, privacy rules, system availability and decisions apply. We are not responsible for external content, outages, rejection, data handling or transactions outside our control.
Liability and Consumer Rights
Nothing in these Terms excludes liability or customer rights that cannot lawfully be excluded under applicable law. Subject to that limitation, Akash Solar Power is not responsible for indirect, incidental or consequential loss arising from website use, estimated savings, business interruption, lost data or third-party decisions.
Any project-related responsibility will be assessed according to the accepted contract, direct proven loss, the parties’ conduct and applicable law. The customer must take reasonable steps to reduce avoidable loss and promptly report a suspected defect.
These Terms are not intended to remove rights available to an eligible consumer under applicable Indian consumer-protection law or to excuse fraud, wilful misconduct or liability that cannot legally be restricted.
Indemnity
To the extent permitted by law, you agree to compensate Akash Solar Power for direct loss, liability or reasonable expense caused by your unlawful website use, false documents, lack of authority, infringement of third-party rights, unsafe interference with the system or material breach of an accepted project agreement.
This clause does not require a consumer to compensate us for loss caused by our own negligence, breach or unlawful conduct.
Events Beyond Reasonable Control
Neither party will be treated as in breach for delay caused by events reasonably beyond its control, including severe weather, flood, fire, epidemic, transport disruption, supply shortage, import restriction, strike, civil disturbance, government action, portal outage, DISCOM delay, grid restriction or similar events.
The affected party should communicate the delay and resume performance when reasonably possible. Payment for equipment or work already supplied remains due unless otherwise agreed.
Suspension and Termination
We may restrict website access, stop communication or suspend work where there is suspected fraud, abuse, unlawful activity, safety risk, repeated non-payment, unauthorised interference or material breach.
Termination does not cancel rights, payments, warranties, liabilities or obligations that arose before termination or are intended to continue afterwards.
Privacy and Electronic Communication
Personal information submitted through the website, phone, email or WhatsApp is handled according to our Privacy Policy. By contacting us, you permit communication relating to your enquiry, survey, quotation, installation, payment, approval or support request.
Electronic records, emails, messages, digital approvals and payment confirmations may be used for project administration, subject to applicable law and verification.
Read the Akash Solar Power Privacy Policy for further information.
Complaints, Governing Law and Jurisdiction
A customer should first contact us with the invoice or quotation reference and a clear description of the issue. Both parties should attempt to resolve the matter in good faith through inspection, correction, written response or another reasonable solution.
These Terms are governed by the laws of India. Subject to mandatory consumer-forum rights and any different jurisdiction expressly stated in a signed project agreement, courts having jurisdiction in Prayagraj, Uttar Pradesh will have jurisdiction over disputes.
Nothing prevents an eligible consumer from using a statutory consumer grievance or dispute-redressal mechanism available under applicable law.
Changes to These Terms
We may update these Terms when website functions, services, legal requirements or business practices change. The revised Terms will be posted on this page with a new effective date.
An update will not retrospectively change an already accepted project contract unless the parties agree in writing or the change is required by law.
